Rules of Behavior

ACKNOWLEDGEMENT OF THE RULES OF BEHAVIOR

The service you are about to enter is intended to help you manage the submission of applications for permanent and temporary labor certification with the U.S. Department of Labor (DOL). By its very nature, this requires an exchange of information. The DOL is strongly committed to maintaining the privacy of personal information and the security of our computer systems. With respect to the collection, use and disclosure of personal information, DOL makes every effort to ensure compliance with applicable Federal law, including, but not limited to, the Privacy Act of 1974, the Paperwork Reduction Act of 1995, and the Freedom of Information Act. None of your information will be sold to third party vendors or operators of mailing lists.

As a user of the Foreign Labor Certification System (FLCS), I understand that I am personally responsible for my use and any misuse of my user account and password. I understand that by accessing a U.S. Government information system that I must comply with the following requirements:

  1. You must safeguard the information to which you have access at all times.
  2. FLCS is intended for official government use only. This means that:
    1. You may NOT use this computer system to prepare and/or submit applications containing false, inaccurate, or misleading information designed to test FLCS's functions or features. When filing applications for permanent or temporary labor certification with the DOL, you will be required to declare under penalty of perjury that the application being submitted for processing is legitimate and permissible, that you have read and reviewed the application, and that to the best of your knowledge the information contained within the application is true and accurate.
    2. It is your responsibility to submit information that is truthful and accurate. Knowingly furnishing false information in the preparation of this application and any supplement thereto or to aid, abet, or counsel another to do so is a federal offense punishable by a fine or imprisonment up to five (5) years or both under 18 U.S.C. 2, 1001. Other penalties apply as well to fraud or misuse of USDOL immigration documents and to perjury with respect to such documents under 18 U.S.C. 1546 and 1621.
  3. FLCS may not be used for commercial purposes, for financial gain, or in support of "for profit" non-government activities.
  4. The government reserves the right to monitor the activities of any user and any machine connected to FLCS.
  5. FLCS and the information contained within are the property of the Federal government. The Department of Labor owns the data stored on these systems, including all messages and information, even those deemed personal. Unauthorized attempts to upload information or change information provided by this service are strictly prohibited and may be punishable by law.
  6. No information may be transmitted on FLCS whose unauthorized disclosure, destruction, or denial of access would cause
    1. severe degradation or loss of a primary function of FLCS,
    2. major damage to government assets,
    3. major financial loss to the government, or
    4. of life or life-threatening injuries
  7. Information that was obtained via FLCS may not be divulged outside of government channels without the express, written permission of the system owner, i.e., the FLCS Administrator.
  8. Any activity that would discredit the DOL, including, but not limited to, seeking, transmitting, collecting, or storing defamatory, discriminatory, sexually explicit, obscene, harassing, or intimidating messages or material, is prohibited. You are prohibited from using this computer system and posting material or information that is unlawful, discriminatory, may be inappropriate or offensive, likely to harm in any manner the integrity of operation of this computer system, or is for any purpose other than filing applications seeking temporary or permanent labor certification from the DOL.
  9. Any activity that violates Federal laws for information protection (e.g., hacking, phishing, spamming, etc) is prohibited. Violators will be turned over to the appropriate Federal law enforcement organization for prosecution.
  10. FLCS user accounts are provided solely for the use of the individual for whom they were created. Sharing the same user account is forbidden and is grounds for terminating FLCS access. Passwords or any other authentication mechanism should never be shared or stored any place easily accessible. If stored, a password may not be stored in a clear-text or readable format.
  11. Passwords should not contain any of the following:
    1. Dictionary words or common names, such as Betty, Fred, Rover
    2. Portions of associated account names, for example, user ID, login name
    3. Consecutive character strings, such as abcdef, 123456
    4. Simple keyboard patterns, such as asdfgh, qwerty
    5. Generic passwords, such as a password consisting of a variation of the word "password" (e.g., P@ssword1)
  12. You are solely responsible for any and all activities that occur under your account information for this computer system. You are solely responsible and must take the necessary steps to ensure that other persons do not obtain your account information to gain unauthorized access to this computer system.
  13. Any security problems or password compromises must be reported immediately to ETA.IT.Security@dol.gov.
  14. I understand that Federal law provides for punishment under Title 18, U.S. Code, including a fine and up to 10 years in jail for the first offense for anyone who commits any of the following violations:
    1. Knowingly accesses an information system without authorization, or exceeds authorized access, and obtains information that requires protection against unauthorized disclosure.
    2. Intentionally, without authorization, accesses a government information system and impacts the government's operation, including availability of that system.
    3. Intentionally accesses a government information system without authorization, and alters, damages, or destroys information therein.
    4. Prevents authorized use of FLCS or accesses a government information system without authorization, or exceeds authorized access, and obtains anything of value.
  15. When you no longer have a legitimate need to access FLCS, you must notify the Help Desk by email immediately so that your account can be terminated.
  16. The Department of Labor, in its sole discretion, has the right to administratively delete or terminate your access to FLCS immediately and without notice, and remove and discard any or all content posted, for any reason, including, without limitation, if DOL believes that you have acted inconsistently with these Rules of Behavior or in violation with applicable law. DOL shall not be liable to you or any third-party for damages relating directly or indirectly to any such termination of your access to the services available through this computer system.
